1. Acceptance of Terms

By accessing or using Getdaxa.io and app.getdaxa.io (the “Service”), you agree to be bound by these Terms and Conditions (“Terms”).
If you do not agree, you must not use the Service.


2. Description of Service

DAXA APP OÜ (“Company”, “we”, “us”, “our”) provides a data API platform that allows users to retrieve structured data related to individuals, companies, and activities.

The Service operates on a prepaid, usage-based (“pay-as-you-go”) model:

  • Users purchase credits (“Balance”)

  • Credits are consumed when making API requests

  • Each request deducts credits based on usage


3. Credits and Payments

  • All payments are prepaid and final

  • Credits have no monetary value outside the platform

  • Credits are non-transferable and non-refundable

  • Pricing and credit costs may change at any time without notice


4. No Refund Policy

All purchases are final.

DAXA APP OÜ does not provide refunds under any circumstances, including but not limited to:

  • Unused credits

  • Partial use of credits

  • Dissatisfaction with results

  • Incorrect API usage

  • Misunderstanding of functionality

  • Technical issues outside our control

  • Account suspension or termination

  • Changes in business needs

  • Duplicate purchases

  • Failure to use the Service


By using the Service, you explicitly acknowledge and agree to this strict no-refund policy.


5. API Usage and Data Disclaimer

  • Data is aggregated from third-party sources

  • We do not guarantee accuracy, completeness, or timeliness

  • The Service is provided “as is” and “as available”

You agree that:

  • You are solely responsible for your use of the data

  • You will comply with all applicable laws

  • You will not misuse or abuse the API


6. Service Availability

We do not guarantee uninterrupted or error-free operation.

We reserve the right to:

  • Modify, suspend, or discontinue any part of the Service

  • Change API structure, endpoints, or pricing

  • Apply rate limits or restrictions


7. Limitation of Liability

To the maximum extent permitted by law:

DAXA APP OÜ shall not be liable for:

  • Indirect, incidental, or consequential damages

  • Loss of profits, data, or business opportunities

  • Errors or inaccuracies in data

  • Service interruptions or downtime

Our total liability shall not exceed the amount paid by you in the preceding 30 days.


8. Chargebacks and Payment Disputes

By purchasing credits and using the Service, you agree that:

  • You will first contact us to resolve any billing issue

  • You may initiate disputes through your payment provider (e.g. Stripe or your bank), however:

    • Credits are non-refundable

    • Services are delivered instantly upon use

If a chargeback or dispute is initiated:

  • We may immediately suspend or terminate your account

  • We may permanently ban access to the Service

  • We may recover associated costs where legally permitted


9. Account Suspension and Termination

DAXA APP OÜ reserves the right, at its sole discretion, to suspend, restrict, or terminate your account and access to the Service at any time, with or without notice, and for any reason or no reason, including but not limited to:

  • Violation of these Terms

  • Misuse or abuse of the Service

  • Fraudulent or illegal activity

  • Excessive or abnormal API usage

  • Payment disputes or chargebacks

  • Actions that may harm the Service

You agree that:

  • Suspension or termination may result in loss of unused credits

  • No refunds will be issued under any circumstances

  • We are not liable for any resulting losses

We reserve the right to permanently block access to the Service.


10. Indemnification

You agree to indemnify and hold harmless DAXA APP OÜ from any claims, damages, or liabilities arising from:

  • Your use of the Service

  • Your misuse of data

  • Your violation of laws or these Terms


11. Governing Law

These Terms are governed by the laws of Estonia.


12. Dispute Resolution

Any disputes shall be resolved exclusively in the courts of Estonia, unless otherwise required by applicable law.


13. Changes to Terms

We may update these Terms at any time. Continued use of the Service constitutes acceptance of the updated Terms.
